Passenger and Baggage Transportation Agreement
PUBLIC CONTRACT
for the provision of passenger and baggage transportation services on KLR Bus company routes
LIMITED LIABILITY COMPANY "LUX-REISEN BIS" represented by Director Khorkavyi Vasyl Ivanovych, acting on the basis of the Statute (hereinafter referred to as the Carrier), on the one hand,
and a NATURAL (LEGAL) PERSON who applied to the Carrier to receive services for the transportation of passengers and baggage or a person in whose name the ticket is issued (hereinafter referred to as the Customer or Passenger), on the other hand,
together referred to as "Parties," and each separately – "Party," have entered into this Public Contract (hereinafter referred to as the Contract, Offer) on the following:
I. TERMS AND DEFINITIONS
1.1. Website – a publicly accessible website that is open for free visual inspection by any person, owned by KLR UA LLC, located on the Internet at https://klr.com.ua/, together with all its functional capabilities, pages, graphics, etc., designed to obtain services for searching for a vehicle, its route, availability of free seats, booking, selling travel documents (tickets) for this transport, and other services.
1.2. Service – paid services for the transportation of the Passenger and his/her baggage in accordance with the route, date, and time of departure of the Carrier's vehicle selected by him/her. The volume of the Service and the start of its provision are chosen by the Customer (Passenger) independently. The list of services provided to the Customer (Passenger) within the framework of the Order may be changed by the Carrier unilaterally.
1.3. Public Offer (Offer) – a public proposal of the Carrier in the form of a Public Contract for the provision of services for the transportation of passengers and baggage, which contains all essential terms and published on the Internet on the website of the ticket sales agent https://klr.com.ua/,
in the Mobile Application https://apps.apple.com/ua/app/klr-bus/id1588675068?l=uk, or https://play.google.com/store/apps/details?id=com.klr.clients&hl=ru (hereinafter referred to as the Mobile Application), and is also published on the websites of any other agents that sell tickets for the Carrier's routes.
1.4. Acceptance of the offer – full, unconditional, absolute acceptance by the Customer (Passenger) of the terms of the Offer without any exceptions and/or restrictions, by making full or partial payment of the ticket price on the website of KLR UA LLC https://klr.com.ua/, in the Mobile Application or from other agents selling tickets for the Carrier's routes.
Acceptance is equated in accordance with Part 2 of Article 642 of the Civil Code of Ukraine to the conclusion by the Parties of a bilateral written agreement on the terms set forth below in this Offer.
1.5. Electronic passenger ticket, itinerary receipt, insurance policy – an electronic digital document stored in the system of the Service provider, ticket sales agent or in the global booking system, contains a complete set of data about the Service, displays the identification data of the Carrier (company providing the Service), the Customer, certifies the purchase of the Service, confirms the right of the person specified in the travel document to use the Service. Provided to the Customer in the form of an electronic document: itinerary receipt/electronic ticket (hereinafter referred to as the Ticket).
1.6. Paper ticket – a travel document of the established form, which gives the Passenger the right to receive transport services in accordance with the data registered in the ticket - name, surname of the passenger, route, date and time.
1.7. The booking request is considered an acceptance by the Customer of this Agreement and means the Customer's consent to compensate for damages incurred by the Carrier as a result of its withdrawal by the Customer. Booking may involve full or partial payment at the time of booking, or payment within the allotted time after booking. Unpaid booking means that the order is reserved for a certain period of time and during this time can be sold only to the Customer who made this Order.
1.8. Customer – an individual, a legal entity, an individual entrepreneur, who, on the basis of an agreement concluded with the Carrier or a Ticket (paper ticket) purchased from a third party for the Carrier's route, has ordered the Service in their own interests and/or in the interests of third parties and/or makes payment for such services.
1.9. Passenger – a person who is indicated as the recipient of transportation services or otherwise uses the services of the Carrier, in accordance with the Ticket (paper ticket).
1.10. Valid travel documents - documents that are recognized as proper in all countries on the territory of which the Passenger is transported, allowing him/her to cross the internal and external borders of countries, the validity of which has not expired or will not expire before the end of the planned trip. The list of these documents depends on the requirements of the legislation of the country from which or to which the Passenger is entering. Any document of the Passenger is not considered a valid travel document if, due to its improper execution or term of validity, foreign competent authorities apply a penalty to the Carrier.
1.11. Baggage – items intended for the personal use of passengers, packed in bags or suitcases, transported on the same flight in the baggage compartment of the bus.
1.12. Hand luggage - small items of personal use that do not exceed the dimensions of 45 cm x 35 cm x 20 cm and weight of 5 kg (outerwear, handbag, bottle of water, umbrella, laptop, etc.). Hand luggage is placed under the feet or on the luggage rack. The Passenger is responsible for the safety of hand luggage during the flight, including stops and borders.
1.13. Rules for the transportation of passengers and baggage – rules established by the Carrier, which determine the conditions, rights, obligations and responsibilities of the Passenger during transportation and in connection with it (hereinafter referred to as the Transportation Rules).
1.14. Personal data – information or a set of information about an individual who is identified or can be specifically identified (name and surname, contact information, payment information, e-mail address, etc.).
1.15. Owner of personal data - an individual whose personal data is processed and who has given consent to their processing.
1.16. Processing of personal data – any action or set of actions, such as collection, registration, accumulation, storage, adaptation, alteration, renewal, use and dissemination (distribution, sale, transfer), depersonalization, destruction of personal data, including with the use of information (automated) systems.
1.17. Consent of the subject of personal data – a voluntary expression of will by an individual (representative of an individual) to grant permission for the processing of their personal data by registering on the website, ticking the appropriate box on the website to grant consent, using the website, etc.
1.18. Service "early booking" - preliminary promotional sale of a ticket.
II. GENERAL PROVISIONS
2.1. This Agreement (public offer) is posted on the Website, in the Mobile Application, on other resources of ticket sales agents for the Carrier's routes, according to Articles 633, 634, 641, 642 of the Civil Code of Ukraine and contains all essential terms and conditions for the provision of Services by the Carrier and offers an unlimited number of persons to receive Services on the terms defined by this Agreement.
2.2. The terms of this Agreement define the relationship between its Parties and are established equally for all Customers (Passengers), except for those who are granted relevant benefits by the legislation of Ukraine (if any).
2.3. The Agreement may be changed without notice unilaterally by the Carrier by officially publishing a new version of this Agreement.
The new version of the Agreement comes into force from the moment it is published on the Website in the Mobile Application and on other resources of ticket sales agents for the Carrier's routes.
2.4. Any Customer (Passenger) has a free opportunity and is obliged to review all the terms of the Agreement in the current version on their computer, tablet or phone by clicking on the name of the Agreement in the graph that requires the Customer (Passenger) to agree to fulfill the obligations under the Agreement and agreement with it.
2.5. If the Customer does not agree with the terms of the Offer, he/she is obliged to stop using the Website or Mobile Application, or other resource for selling tickets for the Carrier's routes and not to perform actions aimed at accepting the Offer.
2.6. By agreeing to the terms of this Agreement, the Customer (Passenger) confirms their authority, legal capacity and solvency, financial capacity, and is aware of the responsibility for the obligations imposed on them as a result of the conclusion of this Agreement.
2.7. The Customer's (Passenger's) full or partial payment is evidence of unconditional acceptance of the Agreement. By doing so, the Customer (Passenger) confirms the accuracy of their (Passenger's) personal data and assumes all responsibility for its accuracy, completeness and reliability. The Customer (Passenger) assumes all possible commercial risks (registration of a new order, change of tariff, refund and other), associated with their guilty actions in admitting errors, inaccuracies when providing personal data.
2.8. The Agreement number corresponds to the number of the Ticket (paper ticket) purchased by the Customer (Passenger), and the date of conclusion of the Agreement is the date of any payment, in account of the selected Ticket (paper ticket).
III. SUBJECT OF THE CONTRACT
3.1. Under the Contract, the Carrier provides services for the transportation of passengers and baggage, and the Customer (Passenger) undertakes to accept and pay for the services provided.
The Customer's (Passenger's) purchase of a Ticket (paper ticket) for the Carrier's route is evidence of the conclusion of a transportation contract.
3.2. For the services provided by the Carrier, the Customer (Passenger) pays him/her funds in accordance with the current tariffs of the Carrier, posted on the Website or in the Mobile Application, or on other resources for selling tickets for the Carrier's routes.
Banking services related to the transfer of funds within the framework of the Agreement are paid by the Party that performs them. Tariffs may be changed by the Carrier unilaterally by posting changed tariffs on the Website, in the Mobile Application, on other resources for selling tickets.
3.3. In the event that this Agreement is concluded by the Customer in the interests of the Passenger(-s), the Customer, by signing this Agreement, confirms and guarantees to the Carrier that the Customer has the necessary powers and authorization from the Passenger(-s) to conclude this Agreement in the interests of the latter. At the same time, the Customer bears joint and several liability provided for by the terms of this Agreement together with the Passenger(-s), and the actions of the Customer create civil rights and obligations for the Passenger(-s) on the terms of this Agreement.
3.4. The e-mail address and/or phone number specified when purchasing the Ticket (paper ticket) is used as the identifier of the Customer (Passenger).
3.5. The Customer who has paid for the Services under this Agreement confirms that he/she has read and unconditionally accepts the terms of this Agreement. If the Customer is not the Passenger, he/she confirms by making payment for the Services that he/she is an authorized person of the Passenger in whose name the payment for the Services is made and by making payment for the Services confirms that the Passenger is aware of the terms of this Agreement and other information necessary for the Passenger to receive the transportation service.
3.6. Information about the route of transportation, the date and time of the beginning/end of transportation, the name of the Carrier, etc. are indicated directly on the Transportation Ticket (paper ticket).
IV. RIGHTS AND OBLIGATIONS OF THE PARTIES
4.1. The Customer (Passenger) has the right:
4.1.1. to receive timely and complete information about the conditions and procedure for the provision of Services;
4.1.2. to refuse the trip, return the Ticket (paper ticket) and receive back the value of the Ticket (paper ticket) - depending on the term of its return:
- cancellation or cancellation of the flight - 100% of the cost of the trip paid by the Customer (Passenger) is returned;
- voluntary refusal on the initiative of the Customer (Passenger) more than 48 hours before the departure of the flight - 15% of the cost of the trip paid by the Customer (Passenger) is withheld upon return;
- voluntary refusal on the initiative of the Customer (Passenger) more than 24 hours before the departure of the flight - 50% of the cost of the trip paid by the Customer (Passenger) is withheld upon return;
- voluntary refusal on the initiative of the Customer (Passenger) more than 12 hours before the departure of the flight - 75% of the cost of the trip paid by the Customer (Passenger) is withheld upon return;
- voluntary refusal on the initiative of the Customer (Passenger) more than 1 hour before the departure of the flight - 85% of the cost of the trip paid by the Customer (Passenger) is withheld upon return;
- voluntary refusal on the initiative of the Customer (Passenger) less than 1 hour before the departure of the flight – the cost of the trip is not refunded.
4.1.3. to receive a seat in the vehicle in accordance with the purchased ticket;
4.1.4. to transport free of charge Baggage within the norms established by this Agreement and the Transportation Rules;
4.1.5. to transport domestic animals within the norms established by this Agreement and the Transportation Rules;
4.1.6. other rights provided for by this Agreement.
4.2. Responsibilities of the Customer (Passenger):
4.2.1. before purchasing the Ticket (paper ticket) familiarize themselves with this Agreement, the transportation rules, the tariffs for transportation and other documents posted on the Website or in the Mobile Application and related to transportation, accurately determine the date and time of the trip, schedule and route, ensure the availability of valid travel documents;
4.2.2. provide the necessary and reliable information when placing an order for the Service;
4.2.3. immediately check the correctness of the data specified in the Ticket (paper ticket) immediately after receiving it and, if errors are found, immediately initiate the necessary changes;
4.2.4. make payment for the Services in accordance with the terms of this Agreement and the tariffs of the Carrier;
4.2.5. keep the Ticket (paper ticket) and present it at the request of the Carrier;
4.2.6. arrive in advance at the place of departure;
4.2.7. have with them all properly executed documents necessary for entry into the countries of destination, transit countries along the transportation route and present them at the request of the Carrier, its drivers and persons who have the right to exercise control;
4.2.8. occupy the place indicated in the Ticket (paper ticket), keep it and present it in unfolded form at the request of the Carrier, its drivers and persons who have the right to exercise control;
4.2.9. carry out boarding (disembarkation) only after the bus has completely stopped;
4.2.10. inform the driver about found forgotten things, documents and valuables;
4.2.11. be informed about the customs rules and the procedure for crossing state borders of countries along the transportation route;
4.2.12. during the provision of the Services, conscientiously follow the recommendations of the ticket sales agent / Carrier and its drivers;
4.2.13. carefully treat the equipment of the vehicle and prevent its damage;
4.2.14. perform other obligations provided for by this Agreement and the current legislation of Ukraine and the legislation of foreign countries along the transportation route.
4.3. The Carrier has the right:
4.3.1. limit or terminate the provision of services for the transportation of passengers and baggage in the event of force majeure circumstances (circumstances of insurmountable force);
4.3.2. stop the vehicle in the event of a threat to the life and health of Passengers or other persons;
4.3.3. independently change the terms of the Agreement, including adjusting current tariffs, changing the terms of this Agreement, publishing notices of such changes on the Website, in the Mobile Application;
4.3.4. refuse the Passenger in transportation in case of violation of the requirements (provisions), defined by the Transportation Rules;
4.3.5. not accept for transportation baggage and items restricted for transportation, on the terms defined by the Transportation Rules, the current legislation of Ukraine;
4.3.6. offer Passengers additional paid services;
4.3.7. demand from the Passenger to comply with the terms of the Agreement, to comply with the legislation of countries along the transportation route, the requirements of the Transportation Rules in force on the territory of foreign countries along the transportation route;
4.3.8. sell reserved but not paid places;
4.3.9. other rights provided for by legislation and this Agreement.
4.4. The Carrier undertakes:
4.4.1. take measures to provide safe, comfortable and high-quality Services;
4.4.2. provide information and consultations on issues that arise for Passengers regarding the use of Services: placing an order, booking a seat, additional Baggage, etc.;
4.4.3. perform other obligations provided for by this Agreement.
V. RULES FOR THE TRANSPORTATION OF PASSENGERS AND BAGGAGE
5.1. The passenger must appear at the place of departure of the bus indicated in the Ticket (paper ticket) no later than 30 minutes before departure and register with the attendant no later than 20 minutes before the departure time of the bus specified in the Ticket (paper ticket).
5.2. In the absence of the Passenger at the agreed place for boarding the vehicle and the departure time, the transportation is considered canceled, and all contractual obligations are terminated at the initiative of the Passenger. In this case, the cost of the Ticket (paper ticket) is not returned to the Customer (Passenger).
5.3. In the presence of force majeure circumstances (circumstances of insurmountable force), the boarding place may be changed by the Carrier unilaterally, of which the Carrier, previously informs the Passenger before the departure of the bus. The passenger is considered to have agreed to the terms proposed by the Carrier without comments and any claims to the Carrier, if the Passenger continues to move on the terms proposed by the Carrier. In the future, the Passenger's claims on any issues regarding this are not considered and are not subject to satisfaction.
5.4. Boarding is carried out on the seats chosen by the Passengers in accordance with the presented Ticket (paper ticket). The carrier has the right to change the number of the seat chosen by the Passenger.
5.5. Children under the age of 12 are prohibited from sitting in the seats next to the driver, i.e. numbers 1 and 2 and behind panoramic seats.
5.6. Children under the age of 12, or height up to 145 cm, travel in special means (child seat/booster).
5.7. Children under 16 years of age are transported only with the consent of parents (adoptive parents), legal representatives. Children aged 16 years are allowed to be transported without adult supervision, but with the permission of one of the parents (legal representative).
5.8. During boarding, the Passenger is obliged to present valid travel documents and hand over their baggage to the baggage compartment. The passenger is warned that if he/she refuses to present documents or in the absence of any of the necessary valid travel documents (expiration of its validity), the Carrier has the right to unilaterally terminate the contract with the Passenger without refunding the cost of the Ticket (paper ticket). The carrier also has the right to refuse to travel to the Passenger if the bus driver has reasonable suspicions that at least one of the travel documents may cause the Passenger problems with the border services and delay during the passage of borders.
5.9. The driver of the passenger vehicle does not allow to travel Passengers who:
5.9.1. do not have tickets or do not present a certificate of the established sample confirming the right to benefits regarding payment of travel;
5.9.2. do not have valid travel documents;
5.9.3. are in a state of alcohol or drug intoxication;
5.9.4. violate public order;
5.9.5. have with them dangerous goods, in particular flammable, explosive and those that may contaminate the bus or clothing of passengers.
5.9.6. passengers presenting a passport of a citizen of the Russian Federation
In the event of non-admission of the Passenger to the trip in the cases provided for by this Agreement, the Agreement is considered fulfilled, notwithstanding the fact that the transportation was performed in a different volume than that provided for by the Ticket (paper ticket), the cost of the trip is not reimbursed and claims by the Carrier are not considered.
5.10. In the event of the detention of the Passenger at the state border for the purpose of checking travel documents, individual inspection, customs procedures for his/her personal belongings, luggage, the Contract is considered fulfilled, notwithstanding the fact that the transportation was performed in a different volume than that provided for by the ticket, the bus has the right to continue the flight without the Passenger, his/her personal belongings and luggage, the cost of the trip is not reimbursed and claims by the Carrier are not considered.
5.11. The bus makes stops on the route in accordance with the schedule, taking into account force majeure circumstances that may arise on the way of the trip and that the Carrier's driver has no possibility to influence (weather conditions, traffic jams, detours, actions and decisions of state regulatory authorities, actions and decisions of state and local authorities and administrations, queues at state borders, traffic accidents with the bus and its unpredictable technical malfunction).
5.12. The duration of stops is announced by the driver. After the stop is announced by the driver, the Passenger is obliged to return to the bus cabin before the end of the announced time. If the Passenger has not returned to the bus cabin within 5 (five) minutes after the end of the specified time, the driver has the right to continue the trip without the Passenger, and the Passenger who is late continues the trip on his/her own, while the cost of the trip is not reimbursed and claims by the Carrier are not considered.
5.13. The arrival time in the Ticket (paper ticket) is indicated approximately, taking into account force majeure circumstances that may arise on the way of the trip (weather conditions, traffic jams, detours, actions and decisions of state regulatory authorities, actions and decisions of state and local authorities and administrations, queues at state borders, traffic accidents with the bus and its unpredictable technical malfunction), including force majeure circumstances.
5.14. If the Passenger does not arrive for a guaranteed transfer or has not been delivered to the destination specified in the Carrier's tickets, the Carrier may provide the passenger with an alternative route, bus and/or alternative delivery option to the final destination. In the event that the Passenger refuses to use the alternative route, bus and/or alternative delivery option, the Passenger is refunded the cost of the unused part of the trip, based on the cost of travel 1km.
5.15. The Passenger is considered to have agreed to use the alternative bus and/or alternative delivery option of the Carrier without comments and any claims to the Carrier, if he/she continues to move by alternative route, bus and/or alternative delivery option to the destination offered by the Carrier. Under such circumstances, in the future, the Passenger's claims on any issues regarding this are not considered and are not subject to satisfaction by the Carrier.
5.16. Boarding and disembarkation of Passengers is carried out in accordance with the Carrier's permits. Boarding and disembarkation in other places is prohibited. The passenger must board the bus at the point of departure indicated on his/her Ticket (paper ticket).
5.17. The schedule does not provide for the disembarkation of passengers within settlements in violation of the Traffic Rules.
5.18. If there is a delay in departure for any reason from the point of departure or arrival at the destination specified in the Ticket (paper ticket), the Passenger may use the trip with a changed schedule and/or route or initiate a refund of the unused part of the trip, based on the cost of travel 1km. In the event that the Passenger has used the trip with a changed schedule and/or route, further claims by the Carrier are not considered.
5.19. If the Passenger arrived at the boarding point in dirty clothes, in a state of intoxication (including the effects of alcohol/drugs) or otherwise threatens, restricts the safety, health or comfort of other Passengers and/or the crew, behaves inadequately, aggressively, suspiciously or does not have valid documents necessary to cross the border, the Carrier has the right to unilaterally terminate the transportation contract. In such case, the Passenger is not allowed to travel, further claims by the Carrier are not considered.
5.20. During the flight, Passengers are prohibited from:
5.20.1. Transporting substances and objects that are dangerous to human life and health, as well as substances and objects that may cause damage to the property of other Passengers.
5.20.2. Consuming any alcoholic beverages.
5.20.3. Smoking in the cabin or in the toilet of the bus.
5.20.4. By their behavior, interfere with the work of the driver(s) or cause inconvenience to other Passengers. 5.20.5. Placing feet on the seats or blocking the aisle in the bus.
5.20.6. Lying on the seats or on the floor of the bus.
5.21. For the safety of the Passenger himself, and also to avoid causing harm to other passengers and the vehicle, it is not recommended to move around the bus cabin and stand in the aisles without undue necessity during the movement of the bus.
5.22. If the Passenger has problems with any state authorities during the trip, as well as if the Passenger violates the Transportation Rules, the bus driver has the right to independently disembark this Passenger from the bus or contact law enforcement agencies and act in accordance with their instructions. In such cases, the cost of the Ticket (paper ticket) is not refunded, further claims by the Carrier are not considered.
5.23. In the event that the Passenger does not comply with customs and border rules and is detained at the border and this causes a delay of more than 15 minutes, the bus driver has the right to leave the border without the Passenger in accordance with the bus schedule and without compensation for the cost of travel, further claims by the Carrier are not considered.
5.24. The carrier does not guarantee and is not responsible for the untimely arrival of buses at the destination, transfers to other modes of transport and other carriers, стыковки рейсов, если такая задержка или неприбытие произошли не по вине водителей Перевозчика, а также из-за условий на которые они не имеют возможности повлиять (задержками во время прохождения границ, погодные условия, пробки на дорогах, объезды препятствий, действия и решения государственных контролирующих органов, действия и решения государственных и местных органов и администраций, очереди на государственных границах, ДТП с автобусом и его непредсказуемая техническая неисправность, ремонтными работами на дорогах и т.д., действиями самих Пассажиров, влиявших на выполнение данных обстоятельств и т.д.), in particular, due to force majeure circumstances.
5.25. Special conditions:
5.25.1. Seats behind the drivers and panoramic seats may be occupied by Passengers over 14 years of age.
5.25.2. To ensure the safety of the passengers themselves, Passengers with limited mobility (sensory or motor, permanent or temporary, mental) are allowed to travel on the bus only when accompanied by another adult. The accompanying person must not have limited mobility.
5.25.3. The bus schedule does not provide time for visiting Duty Free.
5.25.4. All seats on the bus are equally comfortable. The Carrier reserves the right to change the Passenger's seat without prior notice due to a change of bus or wishing to ensure the safety of passengers and drivers, or for the purpose of providing the highest quality transportation.
5.25.5. If the seat on the bus is equipped with seat belts by the manufacturer, the Passenger is obliged to be fastened while the bus is moving.
5.25.6. Passengers on domestic and international routes of the Carrier are allowed to carry baggage free of charge in the baggage compartment of the bus, and hand luggage on the luggage rack in the bus cabin, the number of units, dimensions and weight of which are determined by the Carrier according to the following parameters:
Free of charge, per passenger, it is possible to carry two units of baggage, total weight:
- Poland, Czech Republic, Austria, Slovakia - 40 kg (divided into 2 bags, each not exceeding 20 kg, size 90x60x40cm) and one hand luggage up to 5 kg;
- Germany, Belgium, Netherlands, Luxembourg, France, Switzerland - 40 kg (divided into 2 bags, each not exceeding 20 kg, size 90x60x40cm) and one hand luggage up to 5 kg.
The cost of a preferential ticket includes standard baggage allowances.
When purchasing an additional ticket for 1 person (Trip without a neighbor for -50%), free transportation of one unit of baggage (suitcase) weighing up to 20 kg and measuring 90 x 60 x 40 cm is allowed.
5.26. Additional baggage is transported if there is free space in the baggage compartment of the bus, for which an additional payment of 10% of the cost of the Ticket (paper ticket) is charged for one additional baggage item, except for German routes. On routes from Germany to Ukraine, an additional payment of 1.8 Euro per kilogram is charged, and from Germany to Ukraine, 1.8 Euro per each kilogram. The availability of free space in the baggage compartment of the bus is determined upon boarding.
5.27. The Carrier has the right to refuse the Passenger in the transportation of additional baggage.
5.28. The Carrier does not assume responsibility for any damage to things that are not allowed to be transported in the baggage compartment of the bus, as well as things that are easily broken, quickly perishable, improperly packed, valuable things (money, documents, electronic and technical means, etc.), transported in the baggage compartment of the bus.
5.29. The Carrier does not take responsibility for damage to registered Baggage, in particular for broken wheels and handles, lost strapping belts and minor damage, such as cuts, scratches, kinks or stains that appeared during normal wear and tear and use during the trip. The passenger himself is responsible for the safety of hand luggage.
5.30. The Passenger is responsible for the safety of hand luggage in the bus cabin, it is not allowed to place hand luggage in the bus aisle.
5.31. Transportation of animals is allowed if their weight does not exceed 8 kg. A mandatory condition of transportation is the availability of a portable container (with a hard bottom) and all necessary documents for crossing the border. The cost of a ticket for an animal can be purchased at the full ticket price with a seat provided.
To avoid problems at state borders when traveling abroad with domestic animals, it is necessary to comply with the rules provided for by the Resolution of the Cabinet of Ministers of Ukraine "On Transportation of Animals" No. 1402 of 16.11.2011 and the requirements of the European Union Regulation. The import of domestic animals into the territory of the European Union countries can be carried out with the following documents:
- Veterinary passport. To obtain which you need to undergo:
- microchipping;
- preventive treatment against fleas and worms;
- rabies vaccination and testing for rabies antibody titer.
- Veterinary certificate Form No. 1 or Form 1-VET.
- Carrier cage for transporting animals.

5.32. In the absence of valid travel documents for the transportation of animals, the Passenger will be denied transportation without a refund of funds.
5.33. The "early booking" service is a preliminary promotional ticket sale under the established conditions: * 30% - when buying a ticket 30-39 days before the departure date. * 40% - when buying a ticket 40-49 days before the departure date. * 50% - when buying a ticket 50 or more days before the departure date.
5.33.1. Payment for the service is made directly when ordering the ticket.
5.33.2 For tickets purchased under the terms of the "Early Booking" service, funds are not returned, as these tickets are promotional and information about the promotion is displayed in advertising on the official website of the company https://klr.com.ua/. (Article 15 of the Law of Ukraine "On Consumer Protection")
5.33.3. A ticket purchased under the terms of the "Early Booking" service can be transferred to another date or flight, provided that the difference between the paid amount and the full cost of the new ticket is paid (Article 9 of the Law of Ukraine "On Consumer Protection")
5.34.4 For the "Early Booking" service, the passenger has the right to free transportation of one unit of baggage (suitcase) weighing up to 20 kg and measuring 90 x 60 x 40 cm. For additional baggage (suitcase) that does not exceed 90x60x40 cm and weighs up to 20 kg, the passenger pays 20 euros or 800 UAH. If the suitcase exceeds the allowed baggage norm, a standard additional payment is made (clause 5.26).
5.35. In case of changing the ticket date, name, surname, or route, an additional fee of 10% of the ticket price is charged.
5.36. For repeated ticket changes, an additional fee of 20% of the ticket price is charged, provided that the price difference does not exceed 1000 UAH. If the difference exceeds this amount, an additional payment up to the full cost of the new ticket is required.
5.37. The Passenger may transfer the ticket for an indefinite period. Such a ticket is valid for 45 days from the date of transfer.
VI. LIABILITY OF THE PARTIES
6.1. In case of non-fulfillment or improper fulfillment of its obligations under the Contract, the Parties shall be liable as provided by laws and this Contract.
6.2. The passenger must carefully treat the equipment of the bus, not allow its damage. The passenger is financially responsible for damage caused to the vehicle, and is obliged to compensate the Carrier for it.
6.3. The Carrier is not responsible for the safety of baggage, valuables and documents of the Customer/Passenger during the entire period of receiving services under this Agreement. Responsibility for the safety of his/her property both on the territory of Ukraine and outside its borders rests with the person to whom the Services are provided.
6.4. The Customer is fully responsible for the accuracy of the information provided about himself and the Passengers and the validity of the provided documents. In case of non-departure of the Customer/Passenger due to improper execution of the passport or other necessary documents, including for the child, all financial expenses are borne exclusively by the Customer/Passenger. If during the crossing of the border it is found that the Customer/Passenger does not have or has improperly executed documents for crossing the border and this causes losses to the Carrier, the Customer/Passenger compensates all losses of the Carrier, including fines, penalties, legal assistance costs, etc.
6.5. If the Customer acted without proper authority regarding the purchase of a ticket in the name of a third party (Passenger(-s)) and his actions were not agreed upon with the Passenger(-s), then the Customer bears full personal responsibility for any losses to the Passenger(-s).
6.6. Incomplete payment for the Services by the Customer under this Agreement relieves the Carrier of all responsibility related to the fulfillment of obligations under the Agreement.
6.7. Non-compliance with the Transportation Rules by the Customer (Passenger) may lead to the cancellation of orders and refusal of access to purchased Services, including the ability to use the Ticket (paper ticket), without reimbursement of the costs incurred for its purchase.
6.8. The driver of the passenger vehicle has the right not to allow Passengers who do not have valid travel documents to travel, without returning the money spent on purchasing the Ticket (paper ticket).
VII. FORCE MAJEURE CIRCUMSTANCES
7.1. The Parties are released from liability for partial or full non-performance of obligations under this Agreement if such non-performance of obligations was a consequence of force majeure circumstances that arose after the conclusion of the Agreement as a result of extraordinary events that the Parties could not foresee and could not prevent by their own actions. Such force majeure circumstances include (but are not limited to the following list):
natural disasters, hostilities, war, embargo, quarantine, pandemic, epidemic, decisions of state authorities that caused the impossibility of fulfilling this Agreement. The period of validity of force majeure circumstances is confirmed by a certificate issued by the Chamber of Commerce and Industry of Ukraine (its territorial body).
7.2. Upon the occurrence and termination of the circumstances specified in clause 7.1 of this Agreement, the Party for which the fulfillment of its obligations under this Agreement has become impossible must notify the other Party in writing within 5 working days.
7.3. In the absence of timely notification provided for in clause 7.2 of this Agreement, the Party is obliged to compensate the other Party for damages caused by the absence of notification or untimely notification, except in cases when such notification became impossible due to force majeure circumstances.
7.4. In the event that force majeure circumstances continue for more than one month, each of the Parties has the right to initiate the termination of this Agreement by sending the other Party a written notice 15 (fifteen) calendar days before the projected date of termination.
VIII. TERM OF VALIDITY AND OTHER TERMS OF THE AGREEMENT
8.1. This Agreement enters into force from the date of its acceptance by the Customer (Passenger) and is valid until the full fulfillment of the Parties' obligations.
8.2. Any disputes regarding the performance of this Agreement that arise at the initiative of the Customer (Passenger) shall be considered by the appropriate court at the location of the Carrier, subject to the claim procedure. The claim in writing shall be sent to the location of the Carrier. The claim is considered by the Carrier within one month from the date of its receipt, unless otherwise provided by the current legislation of Ukraine.
8.3. The Parties have decided that in the event of discrepancies between the terms of this Agreement and the provisions of the current legislation of Ukraine, the provisions of this Agreement shall prevail. In all matters not provided for by this Agreement, the Parties shall be guided by the current legislation of Ukraine.
8.4. The Carrier and the Customer (Passenger) exchange messages via electronic correspondence. The Customer (Passenger) agrees that all messages, news, and other communications in electronic form prepared by the Carrier comply with the same legal requirements as in paper form.
Documents transmitted by the Customer (Passenger) by electronic means of communication (electronic documents) may be accepted by the Carrier for consideration before exchanging them for originals.
8.5. The Parties to this Agreement shall take all necessary measures to ensure the confidentiality (non-disclosure) of technological, financial, commercial, confidential, and other information and documentation, trade secrets, and personal data of individuals received from the other Party.
